Family and Domestic Violence and Family friendly work arrangements AM2015/1 and 2015/2: Submission

In its 20 April 2015 Submission on Preliminary Issues, NFF deals with preliminary issues raised in these proceedings, including whether any of the claims made by the ACTU in these proceedings are inconsistent with National Employment Standards (NES) or incapable of inclusion in modern awards under part 2-3 of the Fair Work Act 2009 (FW Act). The submission goes on to discuss whether any elements of the claims made by the ACTU or individual unions are inconsistent with Part 2-1 or Part 2-2 of the FW Act. They go on to identify certain elements of the claim in relation to family and domestic violence that are not capable of inclusion in modern awards under Part 2-3 of the FW Act, and explanations as for why. NFF continues to discuss certain requirements in claims made in the ACTU Submission, including but not limited to the requirement for employers to maintain confidentiality of personal information, and the requirement for employers to appoint a family and domestic violence contact person.
