The NFF’s 15 May 2014 submission to the Australian Law Reform Commission recognises the legal foundations of Native Title, but raises a number of concerns particularly in regards to the introduction of a presumption of continuity, reversing the onus of proof in native title claims and shifting the financial burden of claim resolution to respondents and encourages the lodgement of overlapping claims.
